1. Introduction
These Terms of Service ("Terms") govern your access to and use of the Discover Prep mobile application (the "App") and any related services (collectively, the "Service"), provided by Raj Kohar (doing business as Discover Prep) ("we," "us," or "our").
By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
2. Age and Eligibility
By using the Service, you represent and warrant that you are at least 19 years of age (the age of majority in British Columbia) or the age of majority in your jurisdiction of residence.
Users Under 19: If you are under the age of majority, you may only use the Service with the consent and supervision of a parent or legal guardian. If you are a parent or legal guardian enabling a minor to use the Service, you agree to be bound by these Terms on their behalf and are responsible for all activity on their account.
3. Nature of the Service (No Guarantee of Results)
Discover Prep is a study aid designed to assist users in preparing for the Canadian Citizenship Exam. The Service provides practice exams, podcasts, and paraphrased study materials based on the official Discover Canada guide.
Independent Entity: We are a private entity and are not affiliated, associated, authorized, endorsed by, or in any way officially connected with the Government of Canada, Immigration, Refugees and Citizenship Canada (IRCC), or any of their subsidiaries or affiliates.
No Guarantee: You acknowledge that we do not guarantee that using the Service will result in a passing grade on the citizenship exam or the granting of Canadian citizenship. The Service is provided for educational and informational purposes only.
4. Subscriptions and Billing
The Service offers various subscription plans to access premium content.
- Subscription Plans:We offer Weekly, Monthly, and Yearly (Family) auto-renewing subscriptions, as well as a one-time payment "Lifetime" access option.
- Family Plan:The "Yearly Family" and "Lifetime Family" plans grant access to the Service for up to six (6) distinct family members. You are responsible for ensuring all family members adhere to these Terms.
- Lifetime Access:"Lifetime" refers to the lifetime of the Service (the App), not the life of the user. If the Service is discontinued, "Lifetime" access will terminate.
- Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
- Management: You can manage and cancel your subscriptions via your Account Settings on the Apple App Store or Google Play Store. We cannot cancel subscriptions on your behalf.
5. Refunds
Because our Service is sold via third-party app stores, all billing and refund inquiries must be directed to the respective App Store. We do not have access to your billing details and cannot process refunds directly. Refunds are subject to the policies of Apple or Google, respectively.
6. Intellectual Property
Our Content: The visual interfaces, graphics, design, compilation, code, podcasts, and the paraphrased text within the App are the property of Raj Kohar / Discover Prep and are protected by Canadian and international copyright laws.
Government Content: References to the Discover Canada study guide are used for educational commentary and review purposes. The original Discover Canada guide is the property of the Crown. We make no claim of ownership over the official government text itself.
License to You: We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial study use.
7. Third-Party Links
The Service may contain links to third-party websites. We are not responsible for the content, privacy policies, or practices of any third-party sites. Accessing these links is at your own risk.
8. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. We disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of Liability
To the fullest extent permitted by applicable law (including the laws of British Columbia), in no event shall Raj Kohar, Discover Prep, or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or failure to pass any examination.
10. Privacy and Data Collection
By using the Service, you acknowledge and agree that Discover Prep collects and uses certain information to provide and improve the App.
- Anonymous Usage Data: We collect non-personally identifiable information regarding your use of the Service, including but not limited to quiz scores, study progress, chapter completion, and study duration. This data is used solely to analyze user performance trends and improve the educational content.
- Device and Technical Data: We may collect technical information such as your device model, operating system, crash reports, and coarse location data to ensure the App functions correctly and to deliver province-specific study material.
- No Personal Identifiable Information (PII): We do not collect, store, or share your name, email address, phone number, or any other personally identifiable information. All data collected is linked to an anonymous device identifier.
- Third-Party Services: The Service utilizes trusted third-party analytics and billing providers to process subscriptions and aggregate usage data.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein. You agree to submit to the exclusive jurisdiction of the courts located in Vancouver, British Columbia.
